Two central Florida attorneys say they will sue the Florida Department of Health under the Endangered Species Act to try and stop permitting for septic tanks along the ailing Indian River Lagoon.

The attorneys say stopping the permits will limit the pollution entering waterways that feed the lagoon. On Thursday, they filed a 60-day notice of intent to file a lawsuit on behalf of a Cocoa Beach tourism business and three endangered species that live in the lagoon system – the Florida manatee, the green sea turtle and the Atlantic salt marsh snake.
Health department spokeswoman Sheri Hutchinson tells The Daytona Beach News-Journal that the agency “has been an active partner in discussions regarding the Indian River Lagoon and has taken all necessary steps to protect the public health.”
